Ride-Sharing in Louisiana

The Louisiana Senate recently rejected a bill for statewide rules for ridesharing/transportation network companies [TNC] as Uber, Lyft and the like.   

 

Proponents of the bill say the idea behind it is to allow these companies to deal with a standardized set of rules/regulations (like specific requirements for background checks). They hope it would encourage expansion and availability where there isn’t a large call for taxi services, especially smaller cities.  Currently the companies must deal parish to parish. They also feel it will cut down on drunk driving incidents if people have an affordable option to get home safely, improve

transportation options to people without cars, and create economic opportunity for jobs with flexible hours. 

 

Part of the problem for opponents of the bill is they feel the rideshare companies should have the same rules as taxi cab companies. There is also the question about why the measure would give regulatory oversight to the Agriculture Department, rather than the Public Service Commission, which oversees some trucking operations.  Currently Uber and Lyft operate in a few of markets in Louisiana, like Baton Rouge, Lafayette and the greater New Orleans area.

Regardless of your opinion on the Louisiana bill or where you live, if you’re considering driving for any rideshare company, you put yourself and family at risk if you do not have the proper car insurance coverage.  For one, there is a gap in your auto insurance coverage when you have a TNC app turned on to drive for such a company. According to Safeco Insurance, “The entire time your TNC app is on, your personal auto policy is suspended. Your TNC does provide coverage, but only for the period of time between accepting the passenger and dropping off the passenger (before accepting a passenger, some TNCs may provide limited liability coverage only). No passenger means no coverage for your vehicle and any damages or injuries you may sustain.”

 

Unless specifically chosen as an option, insurance company’s auto policies exclude coverage for incidents that occur when a personal vehicle is used to transport paying passengers, such as during ridesharing (and many companies still do not offer this coverage since it’s a commercial activity…using your vehicle to generate money). If you do choose a ridesharing option/rider, the coverage is a vehicle specific (not per policy). Though potentially a good way to make some extra money, most companies still do not cover the activity. Be upfront with your agent so she/he may help you.
